Jack Thompson: "I guess my "mistake" was not killing 3000 people to make my point"

He fought the law and the law is winning. Jack Thompson, hot off the heels of a Florida Bar recommendation that he be disbarred for ten years for 27 violations of professional misconduct, is again testing if the pen is mightier than the sword. In a letter written to Chief Judge Federico Moreno, Thompson claimed his recent trial was a mockery of the system and demanded a fair trial.

"We find yesterday that enemy combatants at Guantanamo are to get more due process from federal judges than what I am to have. I guess my "mistake" was not killing 3000 people to make my point ... I demand a hearing," Thompson wrote in the letter to Moreno.

Judge Moreno responded to the shocking letter by dispatching two U.S. Marshals to the home of Mr. Thompson. "The purpose of that visit was to intimidate and harass me," Thomson wrote to Moreno following the incident.

As the Florida Bar continues to seek disbarment for the controversial lawyer, Thompson is now seeking a meeting with the House Judiciary Committee in Washington to complain that the Justice Department is harassing him.

Jack Thompson is famously known in the gaming community for his stance against violent videogames, particularly titles from Take Two Interactive; publisher of Rockstar's Grand Theft Auto franchise.

Gamers sue EA over football exclusivity

Football gamers will remember 2004 as a dark year in video game football history. 2004, you see, was the year that EA acquired the exclusive rights to publish NFL licensed football games. Gamers will also remember that the reason why EA acquired the license is because Sega's ESPN NFL 2K5 released that year for a paltry $19.99, which resulted in a huge sales boost and in EA lowering the price of Madden 2005 to $29.95 in response. Once EA acquired the NFL license and effectively eliminated all football competition, it released Madden 2006 for the price of $49.95 the following year.

It seems some have taken exception to Electronic Arts' actions, as Gamespot reports that a pair of gamers in Washington, DC and California have filed suit against the company for "blatantly anticompetitive conduct." The suit mentions the company's acquisition of the NFL license as well as the price hike of Madden 2006 the year following the acquisition. Furthermore, the suit notes EA's ongoing attempt to acquire of Take Two, which would "remove one of the few companies with the ability and expertise to compete in the market for interactive football software." That's assuming EA ever lost its hold on the NFL license, of course.

The plaintiffs seek "restitution and damages" for anyone that purchased an EA football game since August 2005 and "disgorgement of all profits made as a result of anticompetitive actions, and that the infringing agreements be declared null and void."

Update: The suit also makes note of EA's licensing agreements with NCAA Football and the Arena Football League. Along with the NFL, this gives EA the exclusive rights to "the only viable sports football associations in the United States."

Bioshock 3 confirmed, likely coming with the movie

While it was assumed when there was an announcement of Bioshock 2, it's now been confirmed that the series is officially set to be a trilogy. In an investor conference call Strauss Zelnick, Take-Two CEO discussed the movie and the likelihood that it wouldn't be ready in time for the second game (duh) but that it could see release alongside the third in the series. Given the surprising sales of the first game and the potential of the IP at this point, Bioshock 3 is as sure of a thing now as Halo 3 was in 2003. That is to say financially guaranteed, but a long way off.

GTAIV boosts UK 360 sales over PS3

Having already announced that the Xbox 360 version of Grand Theft Auto IV was the week one sales winner in the UK, Chart-Track has now told Eurogamer that the game also heavily boosted sales of the Xbox 360 console. Since Grand Theft Auto IV's launch last month, sales of the Xbox 360 are up 18% over the Playstation 3 in the UK. ChartTrack also notes that sales of the Xbox 360 have increased 47% over the month prior to GTAIV's launch, whereas PS3 sales have seen an increase of only 8%. Furthermore, a full 57% of all copies of GTAIV sold in the UK were sold for the Xbox 360, leaving 43% for the Playstation 3.

It's not all sunshine and roses for the Xbox 360 though, as the Playstation 3 still holds the lead in overall UK sales for 2008 thus far. As it stands, there still remains a 10% gap between the consoles, though it's worth noting that the gap stood at 20% before the launch of GTAIV.

Update: Ahem, the numbers are for the UK, not all of Europe.

The voice of GTAIV's Roman is broke, rent him

Those keeping up on Grand Theft Auto IV (that's all of you, right?) will remember that a few weeks ago Michael Hollick, best known as the voice of Niko Bellic in GTAIV, was covered by the New York Times in an article pointing out that the actor will receive no residuals or royalties of any kind for his performance. It's important to note that he doesn't point the finger at Rockstar but rather the Screen Actors Guild, which does not have specific rules regarding electronic performances.

While Hollick may have landed the New York Times, Jason Zumwalt, the voice of Niko's cousin Roman, has turned to YouTube. Where it could be argued that Hollick's approach to the matter had a certain degree of tact, Zumwalt's approach is a bit ... different. Essentially, he's asking gamers to "Rent Roman." It's all a little hard to explain. Maybe you should just watch the video. Find it after the break (NSFW thanks to some salty language).

EA deadline for Take-Two offer ends tonight

Remember kids, EA's $25.74 per share deadline offer for Take-Two ends tonight at 11:59PM EDT. Originally offering $26 per share and a purchase price of $2 billion, EA had lowered its offer when Take-Two declined to sell in April. Currently trading closer to $27 a share, Take-Two Interactive has been in EA's sights for quite some time--so does anyone think this deadline will stop them from trying again?

EA says they want Take-Two, so are they really going to give up? What else could they do? Well, EA could always lower their offer to Take-Two again, just to scare them. It's like those old sitcoms where two people haggle over money and one gets progressively lower just to scare the other guy into submission. What we're saying is that EA is basically the gaming equivalent of Balki Bartokomous.

Some analysts think this whole thing will be hammered out over the weekend, but we'll have to wait and see.

Rumor: Take-Two buyout news coming Monday

Lazard Capital Markets' Colin Sebastian issued a note on EA's financial statement last night claiming new information regarding the buyout of Take-Two Interactive would be forthcoming Monday. Sebastian, a known analyst with his ear to the "gaming industry grindstone," has been at the forefront of comments regarding a possible EA buyout since the first offer was made in April.

"Expect [an] update on TTWO bid by Monday morning," Sebastian noted. "We continue to believe that the current offer of $25.74 per share would be accretive to earnings for Electronic Arts, as well as fill several meaningful product gaps."

Last month EA extended its tender offer deadline from April 30 to May 16. The offer, if approved, would see Electronic Arts purchase Take-Two Interactive, publishers of the critical and commercial blockbuster Grand Theft Auto IV, for $2 billion. Expect the internet to burst into flames Monday if Sebastian's claim comes to fruition.

Zero Punctuation visits Liberty City

Yahtzee's latest Zero Punctuation review this week is none other than everyone's favorite crime simulator, Grand Theft Auto IV. While he (of course) does his best to pick the game's fault apart one by one, Yahtzee still comes across as actually liking the game. Fans of ZP will know that this is high praise indeed (though we imagine it will still spark nasty, hate-filled emails from GTA fanboys). As for the negatives, the review makes note of wonky driving, escort missions, and the constant need to entertain Niko's friends. Beyond such criticisms though, the review deigns to call Grand Theft Auto IV "really good." Find the review embedded after the break.

Gamestop: GTAIV 360 sells almost 2 to 1 over PS3 in first week of sales

More news regarding the sales of GTA IV! Apparently GameStop has exclusively given its sales figures to Newsweek's LevelUp blog. And the figures say that 64% of all copies of GTA IV sold in the first week of sales were sold on the 360. An even two thirds would've made two to one, but these are only the first week's sales, so who knows how things will pan out as time goes by.

We've heard rumors about the shipment sizes of the PS3 versions versus the 360 versions that (if true) could mean that initial shipment sales of the 360 version simply can't ever match the PS3 version until stocks are refilled. While the Gamestop sales are still good news, we'll have to wait for the April NPD for a more concrete take on the game's long term sales.

GTAIV boasts 40% attach rate with new 360s

Grand Theft Auto IV is selling very well (perhaps you've heard), but did you know that it's also moving Xbox 360s at a blistering pace? On a recent Major Nelson podcast, co-host "e" revealed that GTAIV boasted a 40% attach rate with new 360s during its first week of availability. "The game is attaching well to new consoles, roughly 40 percent of 360s going out the door had a copy of GTA IV going with them," said 'e'. With only the UK sales numbers for GTAIV currently revealed, we'll have to wait for the worldwide 360 numbers before the full significance of the attach rate really means. Whatever the actual figure, we're willing to bet that 40% of all 360 copies of GTAIV represents a lot of consoles.

While there's no way to prove that consumers bought their new consoles specifically to play GTAIV, there's no denying that it helped drive sales. We'll have to wait for the latest NPD numbers to see just how big the GTAIV effect was.

Rumor: GTA IV will return to San Andreas

Ah, sharp-eyed forums posters. Thank you all. Without your tireless efforts the internet's tubes would be quite empty. One of them over on the GTA Forums was messing around with the Rockstar Social Club and found an interesting item, a plane ticket. For Niko. To San Andreas.

While this of course means nothing concrete (it could simply be an homage) it could refer to the DLC, which mas been rumored to resemble entirely new cities. Unfortunately, unlike real-world airplane tickets, there is no departure date for us to pine over. So, San Andreas DLC? Maybe.

Gore Verbinski to direct Bioshock movie

Wow. This could turn out to be great news. According to a Variety article, Gore Verbinski (Pirates of the Caribbean director) has been snagged to direct the movie adaptation of Bioshock. Even better, John Logan, the screenwriter on The Last Samurai, The Aviator, Gladiator and more, is going to be doing the screenplay. AND, the Take Two Chairman, Strauss Zelnick, has supposedly structured the deal in such a way that it actually happens, unlike other notable video games movies that have attempted to run the Hollywood gauntlet. With such a setup as this, we could be looking at the beginnings of the best video game movie ever made. Hmm ... we wonder what Uwe Boll thinks of this?

UK GTAIV first week sales: 926,000 copies

Hey, remember those ridiculously high Grand Theft Auto IV sales estimates Chart-Track provided for the UK? It looks like they weren't ridiculously high enough, as the final numbers have now been released. Sales for the first week of GTAIV availability in the UK reached a whopping 926,000 copies (approximately) with 631,000 being sold on the first day, handily topping the original day one estimate of 609,000. Of the 926,000 copies sold during the first week, 514,000 were for Xbox 360 with the remaining 413,000 going to the Playstation 3.

The game also managed to drive console sales, raising Xbox 360 sales by 125 percent and PS3 sales by 127 percent from the previous week. Perhaps most impressive of all, in its first week of sales GTAIV has already surpassed all but the top three UK titles of 2007 (FIFA 08, Brain Training, and Call of Duty 4). Just to clarify, that's one week sales versus total sales for 2007. One last statistic: GTAIV is now the record holder for one week sales for a multiplatform game in the UK.

Yow.

[Via Joystiq]

Note: You may have noticed that 413,000 and 514,000 don't add up to 926,000. We're guessing that the numbers are the result of rounding one way or another.

Take-Two sues the Chicago Transit Authority

Take-Two Interactive has filed suit against the Chicago Transit Authority (CTA) in a Manhattan federal court on Monday for pulling ads that promoted the controversial game, Grand Theft Auto IV, without explanation. Take-Two Interactive alleges the CTA has violated its free speech and contractual rights, saying it pulled its posters within days of the ads first appearing on April 22.

In the filing Take-Two accused the CTA and its sales agent, Titan Outdoor LLC, of violating a $300,000 campaign agreement that included running Grand Theft Auto IV promotional advertisements on buses and at bus stops throughout the Chicago area, which were scheduled for display for six weeks between April and June.

The advertisements were pulled after a Fox News affiliate questioned the CTA's priorities of promoting the controversial title during a surge of violent crime in the city of Chicago.

Take-Two seeks an order for the transit authority to run the ads as well as monetary damages of at least $300,000.

[Thanks, LeGrande J.]
