
Variety just confirmed with MTV Games that none of the Rock Band 1 setlist tracks will be released as purchasable hunks of DLC. Ever. So, your best bet would be to buy Rock Band used (or borrow it from a friend) and do the 400 MS point song export. Cheap and efficient!

If you mean the record companies should have let Harmonix let the customers export the songs from RB1 for free then I agree with you. Harmonix is making $0 on the export process. It all goes into licensing.

This has an interesting side-effect in that it severely restricts the used-game market for RB1. I was thinking about selling my copy of RB1 since I got RB2, but if I accidentally delete any of the songs I've transfered, then I won't be able to re-transfer them. So I have to keep my copy of RB1, even though I have no intention of ever playing it again. So instead of paying $5 to transfer songs, the real cost is $25 ($5 + $20 from selling RB1).

Should you accidentally delete them, you could grab them again from your download history. Just like with XBLA games - you have a licence for that content, you can re-download it at no additional cost.
Alternatively, simply rent the game later in the future should you need it again. Cheaper than losing the sale price of it.

You don't download the songs from the Internet, you just download a small license that allows you to rip them from the Rock Band 1 DVD. If you delete the songs you would have to rip them from the DVD again.
As for whether to sell it or not, I would personally sell it. I trust myself not to be stupid enough to delete resources that I don't have access to anymore.

I think the 400 point cost mostly just goes to the cost of transfering the license. Personally I'm glad they're doing it at all. Guitar Hero could have, but Activision has not even bothered. The $5 was worth it... I'm willing to bet everyone out there knows someone with the original they could grab for the 15 minutes this takes.

Five bucks is definitely worth the license transfer BUT if you're not connected to Live, like today, then you'll find yourself playing only RB2 and DLC tracks without your RB1 tracks. Unless it's just me but I notice ALL my RB1 tracks gone as I was selecting songs to play [Damn you Microsoft].
So if you don't own RB1 already and you never connect to Live don't bother doing the license transfer. You'll just be wasting $5 and 1.5GB of space on your hard drive.
Right now I'm just disappointed! I've own RB1 since the day it released and now, since Live is down, I have to swap out my RB2 with my RB1 disc.... This may not be a big deal for most people. But, there are times I bring my 360 to a location in my place where a group of my family and friends can enjoy RB. Since I'm unable to connect to Live because I don't have a wifi-adapter nor do I want a long ass piece of cable running through my house I'll never be able to play RB1 song on RB2. If I paid for the license for RB1 I should be able to play it on Live and OFFLINE! Thanks Microsoft for controlling the content I paid for.

The whole "only if your connected to LIVE" thing applies only if the Xbox you're on isn't the one you bought the content with, or if you're trying to use certain things from the video marketplace.
In the case of the RB1 tracks, I believe that this shouldn't even apply, as the LICENSE is what was downloaded from XBLM, not the songs. Therefore, it is the license that requires Xbox LIVE connection (and even then, only if you're on a different Xbox)
So..if your Xbox RRODs...do you do the Xbox 360 License Transfer to transfer the License of a License? Anyway...
Your songs should be working, however. Maybe email HMX? I can't tell you for sure as I was dong a bunch of Tour...and I just realized that I didn't play a single RB1 or DLC track the whole time...
After LIVE reboots, I'd suggest you resolve this issue (esp. if this is the Xbox you bought the license on) with Microsoft and EA Customer Support. Disconnect your network cable first, to make sure that there is truly a problem.

After further research, you are right about using content on a different 360. Though this system I have now is mines it's still not the one I originally transfered all the RB1 songs. Like most people I got the RRoD [for the 3rd time now] and got my system replacement last week. The odd thing is that ALL my DLC tracks works [and I've downloaded most of them from my previous console] its only ALL my RB1 tracks that's aren't recognizable. As you stated earlier this shouldn't even be an issue for RB1 tracks because they're not DLC. That's why I don't understand why only my RB1 tracks are effected and not my DLC when I'm offline.
Xbox Live Support told me to just wait until tomorrow when Live is up and running to 're-update' my system and everything should be back to normal and working fine. To also note, Microsoft automatically transfers ownership of all your DLC from the previous 360 to the "new" replacement system they send you. So even if you're offline you should still be able to play/use any of your DLC.... and once again, as you mentioned, this really shouldn't apply to my RB1 tracks since they are "saved game files" not DLC.
Alls I could do is just log onto Live tomorrow and try playing RB2 again offline [disconnecting my internet] and see if the problem still occurs. If so, they told me to just call them back.
On another side note. He did mention that, "You'll be getting the New Dashboard update tomorrow." Though I may be highly optimistic about this news I'm sure he's just mistaken that "today's maintenance is to prepare for the NXE update." [*crosses finger* Let this be a nice surprise by Microsoft and actually get the NXE tomorrow.]
