In an interview with Kane and Lynch game director Kim Krogh, IGN learned that come Thursday the new set of DLC will be available alongside two other additions. One addition being a set of new achievements that was spotted a few weeks back that'll add an additional 250 Gamerscore. The other goodie we'll see on Thursday is a general title update that's aimed at fixing a few bugs and annoyances found in Fragile Alliance including friendly-fire between re-spawned characters. So Gears of War isn't allowed to come out with flat-out free DLC, but this game can? I understand that this game needs a goodwill offer after their fiasco with Gamespot, but why is Microsoft allowing them to do this?
Maybe I'm wrong, but I seem to remember Epic complaining about not being able to release the second DLC pack for GoW for free, because of MS.

It's because they knew they could make a lot more money from the Gears maps by putting a price on them. Obviously nobody would pay for this, so Microsoft would rather look like the good guy and make them free.

MS is the publisher of Gears so they put their money up to advertise and distribute it. They expected something in return so charged for DLC.

There's no such thing as truly free content SirMikael, everything free on xbox live so far has been paid for by someone. It's either promotional (ie free episode of a tv series) advertisement (movie themes, Yaris game) or in the case of updates like this, the game's publisher eats the cost. After all the negative press swarming around K&L already, it's probably a bit of an apology from Eidos to release this free.
As for the gears content? As the publisher of the game, and the owner/maintainer of xbox live, MS would have been stung twice had the offered the content free. Epic got paid for those maps, I assure you, and from MS' pocket, since they're the game's publisher. Where it gets sticky is this: developing maps and the like costs money, maintaining data centers, and internet connectivity ALSO costs money. So here we have MS spending cash not only on the development of the maps, but also on the hosting, etc. where normally if they weren't the publisher they'd be getting paid. This probably wouldn't have been an issue had they not ALREADY paid Epic (please excuse me) epic amounts of cash, and spent similarly epic amounts on the advertising of the thing. So if you're pissed about the content for Gears not being free, write a letter to MS and ask them to not stress about exclusivity, and to back off on the advertising campaign next time so they'll have some $$$ left in the game's budget ;)

If Microsoft was willing to pay Epic such a large sum to keep Gears of War exclusive, you'd think they'd want to keep them happy by not trying to make Epic look like the bad guys.
The task of a publisher is usually the marketing, manufacturing and shipment of games - not the development of extra content. Epic's issue was that they can release it for free to PC users, but not on the 360.
Correct me if I'm wrong.
