Too Human developer Silicon Knights is not happy with Epic Games or their Unreal Engine 3 and when they get angry, they like to sue. Silicon Knights recently filed a lawsuit in a North Carolina district court stating that Epic Games breached their contract by not supplying final engine code for the Xbox 360 and claims that Epic used licensee fees to promote its own games while sabotaging their licensee's projects. According to Silicon Knights, Epic was supposed to supply the final Xbox 360 code for the Unreal Engine 3 six months after the launch of the console (around March 2006), but failed to and only got the code to them in November 2006 with no guidance on how to implement the new code. Epic flat out denies such wrong doings and vows to fight the lawsuit. We ask, can't we all just get along?

If Epic really did delay the code distribution by 6 months and failed to provide proper documentation this is actually one of the few legitimate cases filed in recent years.
With the anouncement of PC exclusive content and even possibly the release of Mac versions of GoW and UT07 I feel no sympathy for Epic if the facts of the case are true, unless Epic had a delay due to technical reasons, in which case a dispensation is in order.
Either way Epic will hardly eat into the money it made on a single day of GoW sales if it losses.

Isn't it in Epic's interest to give they licensee's the best support so they can make great games and in turn that would be a promotion for there product... Let's just hope Too Human is going to be great....

JM, at the moment there are hardly any UE3 games out for the 360. The only known games running on UE3 are Gears of War, the XBLA game Roboblitz and Hour of Victory. (Rainbow Six Vegas doesn't count, that game runs on UE2.5) That's a rather poor success rate for an engine that was supposed to be finished March 2006. There have been other developers complaining about the state of the UE in the press in the past, games using UE have known multiple delays (Mass Effect, Bioshock, Stranglehold, Lost Oddysey) or even canceled. The latest UE complaints were about the state of the PS3 version of UE. That's why Fatal Inertia, originally a PS3 exclusive, first became a multiplatform title and then a 360 exclusive: the PS3 version just didn't perform as expected.
I think the biggest problem is that Epic bit off more than they can chew. They promised a working engine way before it was finished. Other developers bought into Epic's claims but when they started working on their own games for real, found there were serious performance issues. Epic then scrambled to get their engine fixed by working on their own game (Gears of War for the Xbox 360). When that game was finished, they'd also fixed most of the flaws in their engine. Its no coincidence that the delivery date was November 2006, the month that Gears of War launched. Only problem: they'd missed their own deadline by more than 6 months, the engine was optimized for shooter games (and still wasn't fit for use in racing games and other genres like they promised), plus they had pissed off licensees by putting themselves and their own game first. I don't think companies working on other shooters could have been pleased to see Epic getting a highly praised, truly next gen game out the door while their own UE games running on older, beta versions of the engine still ran like shit and had to be delayed.
Now the same thing is happening for the PS3. UE3 for the PS3 is still a work in progress, companies that are using it already can't get the games in a publishable shape and have to wait for Epic to finish it. And again, Epic is doing it by getting their own game Unreal Tournament working first. When that game is gold, the PS3 UE3 is finished too. Epic happy, other companies pissed off again because they had to delay their own games once again.

It's kind of ridiculous to me that SK is getting blamed for this stuff. If part of your contract is that you will receive new code by a certain date and you do NOT receive that code, then the party making the code is breach of contract. End of story. And that's just one thing on a huge list of issues they've pointed out, including some pretty basic things.
It wouldn't matter if this was Funtime Productions making Fuzzy Wuzzy the Cute Bear or SK making Too Human. Certainly this game has been taking them FOREVER, but considering they've been showing progress on the 360, it could be said that /some/ of the delay might be to blame on this engine.
They've already started making their own engine because of it. We're talking about practically starting from scratch and losing a shitload of money because of it. I can't imagine a company sitting around and making their own engine because they're just "cry babies". When you really think about all the other UE3 games out there, most of them have seen delays as well.

I would not be so quick to jump the gun and place blame one way or the other. We do not know all the facts involved, we just assume we know something because we read a story in an online blog. I have always found it funny, how people think they can read a one paragraph article and think they know absolutely everything surrounding a given situation; and then pass judgment right there on the spot. The actual lawsuit itself is over 50 pages, so I honestly do not think anyone is going to read one paragraph of blog and just know all.
The charge is "breach of contract", and something like that usually works out pretty straight forward in the courts; even in technological and IP cases.
I will say this. Epic had better hope for their sake that they are in the clear on these allegations. Should Silicon Knights take them to court and win, that is going to open up all manner of lawsuits from other developers and publishers who may feel they to have suffered a breach of their contracts with Epic.
We'll just have to wait and see on this one.

Unreal 2, by far. An engine that allowed a (then) novice such as myself, to create a map that everyone, including myself, could enjoy? Brilliant. Unreal 3 looks and feels amazing (The ground really seems solid, and you solidly stuck to it. It's hard to describe, but on some engines you just sort of float...like in Oblivion) and I can't wait for Unreal Tournament 3.
But to get back on topic, I'd say that if Silicon Knights didn't want the engine, then they shouldn't have bought it. Noone forced them to buy it months late (if they really did, epic disputes) and I doubt Epic signed anything promising the final engine code to ship by *Insert date here*.
Noone really wanted to buy Too Human before this, and now that they've sued Epic (home of Cliffy B, come on now!) they will probably lose face even more. I could really care less what the people that are bringing me Too Human say, compared to what the people that are bringing me Unreal Tournament 2007 (Unreal 3, whatever) have to say. They've earned my trust, time and time again.

Not to me.. people are so busy chugging down on GoW's cock.. how can Epic do any wrong in their eyes?
If some online retailer didnt ship that DVD you ordered for 6 months after purchase you'd be pissed.. unless they made GoW and then everyone would blame the postal service.
Seriously, Too Human asied, shit game or not.. Epic made a promise.. Epic welched on that. People are pissed. Just because they made GoW doesnt make them untouchable, nor does it allow them to stiff the competition.
